Veteran Contracts

Veteran Contracts Mr. Busch of the Busch Law Firm is a veteran, as was his father, father in-law and other extended family members - including his son who is currently a Marine Officer on active duty. Not only does our firm understand government contracts better than most, we understand the military better than most. We also understand the needs and status of our veterans.

Veteran-owned businesses are a unique and important element in the United States economy. Therefore, veterans are an important element of the Busch Law Firm practice.

Service Disabled Veteran Owned Small Business

In support of that, the Government has created preference statutes that are focused on procurement opportunities for veterans or Service-Disabled Veteran-Owned Small Businesses.

The following are a few key legislative actions that provide unique procedures for our veterans entering the Government marketplace:

  • Veteran Entrepreneurship and Small Business Development Act of 1999 (PL 105-50);

  • Veterans Benefits Act of 2003 (PL 108-183); and

  • Veterans Benefits, Health Care and Information Technology Act of 2006 (PL 109-461).

These Acts are designed to set procurement goals for veteran awards for government agencies, enable preference restrictions to only veteran-owned business competitions and award sole-source or set-aside contracts to veterans.

VA Contracts

There are two main programs established to provide veterans opportunities in the federal marketplace:

  • Veterans First Contracting Programs; and

  • Service-Disabled Veteran-Owned Small Business Procurement Program.

These programs establish the procedures to make or challenge a preference certification status. Size, eligibility and ownership status are a few categories subject to review in a program or preference challenge.

Contract Bundling or Consolidation

There are two issues that have a negative effect on the preference programs for veterans:

  1. A Government agency's attempt to combine different contracts into one large contract. This involves previously awarded contracts only to small business through different, separate contracts and now combined into one large contract; and

  2. When multiple separate work efforts, which could have been performed separately in an economical manner through a contract to one small business, are combined into one much larger solicitation.

The bundling of the work and contracts creates new larger solicitations and awards. The larger solicitation arguably gives a large business an advantage over the smaller businesses, including Veteran-owned small businesses. If the agency attempts to "consolidate' or combine contracts previously performed by small businesses into one solicitation, a Veteran-owned small business's ability to compete or maintain its competitive status could also be adversely affected.

Veteran-owned small businesses must be aware of the solicitation requirements and evaluation factors. This is critical for competition.
